Terms of Service

What you agree to when you use Atelier — how the canvas may be used, who owns the work that comes out of it, and how billing runs.

1. Acceptance of these terms

By accessing or using Atelier (“the Service”), operated by Allcognix AI Technologies Pvt Limited, you agree to be bound by these Terms of Service. If you disagree with any part of them, you may not use the Service. They apply to everyone who visits or uses Atelier, on any plan, including the free one.

2. Acceptable use

You agree to use the Service only for lawful purposes. You agree not to use it to:

Prohibited activities

  • Illegal or harmful content — generate or distribute anything illegal, threatening, abusive, harassing, defamatory, obscene or otherwise objectionable.
  • Hate and harassment — produce content promoting hate speech, discrimination, harassment or violence against people or groups on the basis of race, ethnicity, religion, gender, sexual orientation, disability or any other protected characteristic.
  • Deceptive design — produce interfaces intended to impersonate a real organisation, harvest credentials or payment details under false pretences, or otherwise mislead the people who will see them.
  • High-stakes regulated content — present generated material as qualified medical, financial or legal advice. The Service is not built for applications where an error could cause serious harm.
  • Fraud — phishing, identity theft, financial fraud or any other deceptive or illegal scheme.
  • Infringement — generate designs, marks or assets that infringe another party’s copyright, trademark or other intellectual property.
  • Malicious code — generate or distribute malware, viruses or other harmful code.
  • Abuse of the platform — circumvent credit limits, resell generation capacity, scrape the Service, or run automated traffic against it outside a documented interface.

Breaching this section may result in immediate termination of your account, and legal action where appropriate.

3. AI output disclaimer

Read this one. Layers generated by Atelier may contain errors, inaccuracies or invented detail. The Service is provided “as is”, without warranties of any kind, express or implied, including warranties of accuracy, completeness or fitness for a particular purpose.

You acknowledge that:

  • Generated work should be reviewed by a person before it is used or published
  • You are solely responsible for the accuracy, legality and appropriateness of anything you make with the Service
  • We do not warrant that the Service will be error-free, uninterrupted or secure
  • We are not liable for losses arising from your use of, or reliance on, generated content
  • Generated content should not drive decisions of consequence without human oversight

4. Who owns what

Your input

You keep all ownership of the briefs, files, uploads and other material you bring to the Service (“User Input”).

Your output

You own the frames and layers the Service generates from your User Input (“Generated Output”), subject to your compliance with these Terms and applicable law. You can use them commercially, on any plan.

The Service itself

Atelier — its software, models, interface, documentation and brand — remains the exclusive property of Allcognix AI Technologies Pvt Limited, protected by copyright, trademark and other intellectual property law. Nothing here transfers any of it to you.

By using the Service you grant us a limited, non-exclusive, royalty-free licence to process your User Input solely in order to provide and improve the Service, as described in our Privacy Policy.

5. Your account

Some features require an account. You agree to:

  • Give accurate, current and complete information when you register
  • Keep that information up to date
  • Keep your credentials secure and not share them
  • Accept responsibility for everything done under your account
  • Tell us immediately if you suspect unauthorised use

6. Payment and billing

If you buy a subscription or a credit pack:

  • You agree to pay the fees shown at checkout for your account
  • Fees are charged in advance — monthly or annually for a subscription, or once for a credit pack
  • Fees are non-refundable except as set out in our Refund & Cancellation Policy
  • Credit allowances reset each billing period and do not roll over
  • We may change pricing with 30 days’ notice
  • You are responsible for any taxes that apply to your use of the Service

Payments are processed by Stripe or Razorpay, depending on your region and checkout method.

7. Termination

We may suspend or terminate your account and access to the Service immediately, without prior notice, for any breach of these Terms. On termination your right to use the Service ends at once. You may close your account at any time from Account Settings, or by writing to support@allcognix.com.

8. Limitation of liability

To the maximum extent permitted by law, Allcognix AI Technologies Pvt Limited shall not be liable for any indirect, incidental, special, consequential or punitive damages, any loss of profits or revenue, whether incurred directly or indirectly, or any loss of data, use, goodwill or other intangible losses resulting from your use of the Service.

9. Changes to these terms

We may modify these Terms. Material changes will be posted on this page with a new “last updated” date. Continuing to use the Service after that constitutes acceptance of the updated Terms.
